EXEMPTION FROM SUBSECTION 702.19(a)(i and ii) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Blackcomb Helicopters Ltd., 8621 Fissile Lane, Whistler, B.C., operating under Subpart 2 of Part VII of the Canadian Aviation Regulations (CARs), from the application of subsection 702.19(a)(i and ii) of the CARs, subject to the following conditions.

Subsection 702.19(a)(i and ii) requires that, for a pilot-in-command to permit a person to leave a helicopter in flight, the helicopter must be operated at a low hover, and in such a manner that the person is able to alight directly onto the supporting surface.

PURPOSE

The purpose of this exemption is to allow Blackcomb Helicopters Ltd., 8621 Fissile Lane, Whistler, B.C., to conduct a stunt for the filming of the television production “Whistler”, in which a stunt person will jump from a hovering helicopter.

APPLICATION

This exemption applies only to Blackcomb Helicopters Ltd., 8621 Fissile Lane, Whistler, B.C., during aerial work operations conducted with a helicopter Type AS355 when operated pursuant to its Air Operator Certificate Number 7496, during filming of the television production  “Whistler”, at Rainbow Mountain, Whistler, B.C.

CONDITIONS

This exemption is subject to the following conditions:

  1. The operation shall take place between Friday, February 23, 2007, and Friday, March 2, 2007 between the hours of 08:00 and 18:00 Pacific Standard Time subject to suitable weather conditions.
  2. The site of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being the Rainbow Mountain area, Whistler, B.C.
  3. Operations shall be conducted within the specified hours, under Day VFR conditions, using a AS355 type helicopter.
  4. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground.
  5. The aircraft shall be flown in compliance within the “Height-Velocity” Diagram contained with the approved Aircraft Flight Manual.
  6. The aircraft shall conduct a power check immediately before commencing the operation,
  7.  and the engines shall be at, or above, the manufacturers specifications.
  8. The aircraft shall remain clear of all buildings, structure and/or assemblies of persons at   all times.
  9. Blackcomb Helicopters Ltd. shall nominate a safety coordinator. The safety coordinator shall be positioned on the ground in such a position that they can safely observe the operation, judge the height of the helicopter, and give visual signals to the pilot and stunt person when it is safe for the jump to proceed.
  10. A program of progressive training for the pilot, the person leaving the helicopter, and the safety coordinator shall be followed
  11. The maximum height of the helicopter, above the point at which the stunt person will make contact with the surface, shall be no more than five (10) feet. Progressive training shall commence at a height of no more than three (2) feet.
  12. The person leaving the helicopter shall wear a safety helmet of such a design that it will not become accidentally detached at any time.
  13. The area beneath the helicopter, shall be clear of persons and obstructions.
  14. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  15. A copy of this Exemption shall be carried on board the aircraft while operating in Canada.

VALIDITY

The authorization is in effect until the earliest of the following:

  1. 20:00 hours PST, British Columbia, on Friday, March 2, 2007;  
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
